Series consists of rough minutes, 1797-1840, and draft minutes and reports, 1793-1841; a single item, dated 1789, but which was forwarded to the Clerk, John Small, in 1810; a fair hand copy of part of the minutes found in the Land Book which covers the years 1824-1826; an undated nominal index bearing no obvious indication of the records to which it relates, but which may be a draft index to Land Book minutes; and two draft indexes - one to the Land Book covering the years 1811-1816 and the other probably to Land Book minutes ca. 1800-1805. The records form rather a miscellaneous series of documents produced or accumulated by the Clerk of the Executive Council. The rough minutes include both those relating to land and to state matters. The surviving draft minutes illustrate how matters were presented in Council and the evolution of an Order-in-Council. The distinction between rough and draft minutes is a fine one. The records in this series indicate an evolution in practice such that in later years the rough minutes were taken on loose sheets while the draft minutes were written out on paper stitched into bundles or soft-covered volumes. Available evidence points to the rough minutes having been drawn up by the Clerk prior to a Council meeting and, as such, served the function of an agenda that the Clerk would use during the meeting. The draft minutes, on the other hand, were created by the Clerk as his initial version of the proceedings of the meeting. They would have then been proofread, amended as required, and entered into the minute books as the final approved minutes. This classification is not perfect, however, and users should check both rough and draft minutes.
